Do Nothing and See What Happens

We know that no one really wants to file bankruptcy. We completely understand this. However, in many situations, bankruptcy offers the best solution and the most powerful relief. Although some people have simply lost control over their finances, more often than not, it is a result of the loss of employment, divorce, or illnesses and through no fault of their own. We meet with hundreds of clients that were exactly where you are right now. Unfortunately, many of them have depleted their savings, borrowed against their 401(k) and other retirement or tax exempt accounts, or sold assets just to keep their heads above water. This is unfortunate because a lot of these assets are exempt under the law and could have been retained in bankruptcy.

The attorneys at Edwards & Edwards can access your financial situation and help you form a plan of action. There are basically three (3) options: (1) Do nothing and see what happens; (2) Negotiate with your creditors; and (3) File bankruptcy and either eliminate or restructure your debt.

Doing nothing is the most common response when a person is overwhelmed with debt and can’t keep up. This is the worst decision you can make and will only lead to more problems, including creditor harassment of you, your family members, neighbors and friends, collection notices, lawsuits, judgments, and wage garnishment. There may also be tax consequences if your creditor “writes off” your debt therefore giving you even greater problems with the Internal Revenue Service. Creditors may also put liens on your property, making it difficult to sell those items in the future.

Defaulting on your debts can have devastating effects on your life. In some cases you can work with your creditors to resolve the debt and avoid bankruptcy. However, if your debt is considered “bad debt” or a lawsuit has been filed to collect the deficiency, it may be necessary to file for Bankruptcy to gain a fresh start.
